Your use of the website www.ffswatches.com consitutes your acceptance of the terms and conditions.

  1. Scope
    1. These general terms and conditions (below refered to as T&C) apply to all contracts or agreements between a consumer or a company (below refered to as customer or buyer) and the seller concerning all products and services offered on www.ffswatches.com by Felix Schlüter, Frederik Schlüter GbR.
    2. In this T&C, we use the following definitions:
      1. Consumer is every natural person that enters a contract or agreement with Felix Schlüter, Frederik Schlüter GbR neither in excercise nor interest of his or its trade, business or profession. 
      2. An entrepreneur is every natural or legal person or a partnership with legal capacity that enters a contract or an agreement with Felix Schlüter, Frederik Schlüter GbR in exercise or interest of his or its trade, business or profession. 
    3. In any agreement between a customer and Felix Schlüter, Frederik Schlüter GbR the only terms and conditions that hold are those of this website and as hereon stated to the time of the agreement.
    4. This T&C apply to all products currently offered by Felix Schlüter, Frederik Schlüter GbR on www.ffswatches.com and all products that will be offered in the future.
    5. Felix Schlüter, Frederik Schlüter GbR reserves the right to make changes to the T&C of this website at any point in time. Changes to this T&C can only be made by Frederik Schlüter or Felix Schlüter and any other partial or complete modification of the T&C carried out by third parties is not valid.
  2. Offer, Acceptance and Conclusion of Contract
    1. Every offer made by Felix Schlüter, Frederik Schlüter GbR is non-binding and is to be understood as an invitation to the consumer to provide a counter-offer. 
    2. When an order is placed, an offer is sent to Felix Schlüter, Frederik Schlüter GbR and it is only accepted if the product is still available.  Only after a formal accpetance of said offer from Felix Schlüter, Frederik Schlüter GbR, there is an agreement between seller and consumer. In case the offer is rejected, the consumer will be informed via e-mail and the full payment will be refunded.
    3. The acceptance of an order is sent via e-mail with the purchase details as well as invoice. This written order confirmation represents the acceptance of the order placed by the customer.
    4. Felix Schlüter, Frederik Schlüter reserves the right to cancel or reject an order without being liable for any damages or costs under following situations:
      1. The ordered product is out of stock. 
      2. The order placed is suspected to be fraudulent.
      3. There are erros in the product description, price or images.
      4. A delivery to the consumer is not possible due to shipping limitations.
      5. The customer does not pay the purchase price within the time frame indicated in 4.F.
    5. The wording of the purchase contract is saved by the seller but inaccessible by the consumer. 
  3. Price and Payment Conditions 
    1. All prices on www.ffswatches.com are in euros and include VAT. Note that products may be differential taxated.
    2. The amount corresponding to VAT is indicated in the invoice unless the product is differential taxated as stated in §25a UStG (German Tax Law).
    3. Shipping and payment costs can be found in every product description.
    4. All payment options are listed in the product description. Payment fees, shipping costs and/or import sales taxes are to be paid by the consumer. 
    5. In the order confirmation email,  the customer obtains the final price including VAT and/or shipping costs.
    6. The customer is obligated to pay the whole price within three days of recevieving the order confirmation email. In case the consumer does not pay whithin this time frame, Felix Schlüter, Frederik Schlüter GbR will immediately cancel the order and with this, the agreement between buyer and seller becomes invalid. In this case, no explanation or warning from Felix Schlüter, Frederik Schlüter FFSWATCHES GbR is necessary.
  4. Shipping and Conditions
    1. The product is sent to the address provided by the customer. In case a mistake has been made and the shipping address needs to be changed, the customer should contact the seller as soon as possible.  In such a situation, we will try to do everything we can to find the product. However, in this case, neither Felix Schlüter, Frederik Schlüter GbR nor the carrier can be held responsible for the loss of the product.  If the customer pays via PayPal, he/she should make sure that both shipping addresses (PayPal and www.ffswatches.com) are the same. In order to avoid potential fraudulent PayPal claims, the seller will contact the customer to clarify any errors.
    2. If the carrier is unable to deliver a product to a customer and it is sent back to the seller, the customer must pay any further shipping costs. This does not hold in case of a severe impediment (e.g. hospital stay).
    3. Every item can be personally picked up at the product location (Frankfurt am Main or Hamburg). The product location can be found under “Specifications” in the product description.
    4. Every item is shipped as soon as possible. Usually within 1-3 business days after receipt of payment.
    5. In case of transport damage, the customer must contact the seller immediatly. Any claims for transport damages that have not been communicated to the seller within 1-2 days of receipt are not valid.
    6. If the customer is an entrepreneur, the risks associated with the transport lies with the buyer.
  5. Reservation of Property Rights
    1. For customers: The seller maintains the property rights of every product until the receipt of payment. 
    2. For entrepreneurs: The seller maintains the property rights of every product until the buyer has fullfilled every requierement of the business relationship.
  6. Liability for Defects/ Warranty
    1. For consumers:
      1. If the purchased item is defective, the legal regulations regarding the liability for defects apply. 
      2. The warranty period of used items is one year starting on the day the item is shipped with exception of the two following situations. 
        1.  Customer claims for damages and reimbursement of expenses.
        2. Fraudulent concealment of a defect by the seller. 
      3. An item will be excluded from warranty in the following situations:
        1. The item has not been properly used.
        2. The customer has not informed the seller about transport damages within the time frame stated in 4.E.
        3. The customer tries to repair the watch either by himself or third party without informing the seller.
      4. Excluded from the warranty are waterproofness, signs of wear (e.g. scratches on the bracelet) and watch precision.
      5. In case of a subtitute delivery, the warranty time frame remains unchanged.
    2. For entrepreneurs:
      1. If the purchased item is defective, the seller deciedes about the subsequent producedure.
      2. The warranty period for new items is one year.
      3. Any claim concerning the function of a used item is in principle not valid.
  7. Liability 
    1. The seller is only unlimited liable under following conditions:
      1.  Damage caused by intent or reckelness of Felix Schlüter, Frederik Schlüter GbR.
      2. Warranty compromise unless arranged otherwise.
      3. Obligatory Liability as stated in the Product Liability Law.
  8.  Applicable Law
    1. These T&C are applicable in accordance with the German Law.
  9. Competent Court
    1. The competent court is that of the seller. 
  10. Alternative Dispute Resolution
    1. For customers: The EU commission provides an online platform to solve disputes.
    2. The seller is not obligated to participate in the dispute resolution procedure.
  11. Identification Obligation: Money Laundering Act
    1. For transactions over 15.000 euros there is an identification obligation according to the Money Laundering Act. 
    2. For consumers: To verify the identity of the customer an internationally accepted identity document is needed (e.g. passport).
    3. For entrepreneurs:  To verify the identity of an entrepreneur an excerpt from the commerical or cooperatives register.
  12.  Obligation to Inform according to the German Battery Act (BattG)
    1. Discharged batteries are special waste and should not be disposed of in the domestic waste. Every customer can send us old batteries and we will correctly dispose of them. Pollutant batteries containing toxic substances are marked with the sign:
      1. Pb = lead
      2. Cd = cadmium
      3.  Hg = mercury
      4. Li = lithium 
      5. Ni = nickel 
      6. Mh = metal hydride 
      7. Zi = zinc
